This Privacy Policy describes how we collect, use, disclose, retain, and protect personal information. It applies to information processed through santillanus.us (the "Site") and related client communications, unless a signed contract states otherwise.
2. Scope
This policy applies to:
- visitors to our website and related pages;
- homeowners and property managers who submit a contact form, service request, phone call, or email;
- clients who receive a proposal or contract for masonry, landscape, drainage, or mixed outdoor work;
- people who communicate with us about a jobsite, permit, inspection, or payment.
This policy does not apply to third-party websites, platforms, or services we do not control — even if linked from our Site. Those providers keep their own privacy practices. It also does not replace a written construction contract; if a signed agreement has specific confidentiality terms, those terms control for that job.

Our Site is intended for people seeking stone, landscape, and drainage services in Denver and nearby Front Range cities. In Colorado, building contractor licenses are issued by cities and counties. SANTILLAN CONSTRUCTION INC does not currently hold a Denver (or other Front Range city) building contractor license, and this Site does not advertise custom homes, additions, or ADU construction.
4. Information We Collect
Depending on how you interact with us, we may collect the following categories of information.
4.1 Information you provide directly
- Contact details — name, email address, phone number, and mailing address when provided.
- Project and property information — city, street address or lot location, access notes, HOA or municipal constraints you tell us about, project type (stone, landscape, drainage, or mixed), and the message you write on a form.
- Jobsite media — photos or measurements you send of a wall, patio, slope, interior, or country lot. We use these to prepare a visit, not as a substitute for standing on the site.
- Billing and contract records — invoices, deposits, progress draws, change orders, and payment status needed to perform contracted work.
- Material and design choices — stone samples, plant lists, drawings, or selections you approve so we can order and install.
4.2 Information collected automatically
- Device and browser data — browser type, operating system, device type, language settings, and referring URLs.
- Usage data — pages viewed, time on page, and how you move through the Site.
- Network and security data — IP address, approximate location derived from IP, and technical logs used for security and abuse prevention.
- Cookie and similar technology data — as described in our Cookie Policy, including your Accept or Decline choice stored locally under

4.3 Information from third parties
- Square confirming that a card invoice was paid, if you pay that way;
- your bank confirming a check or ACH payment;
- hosting or email providers supplying technical logs;
- public property or permit information relevant to a bid when you ask us to pull it or when a jurisdiction requires it;
- suppliers or subcontractors confirming orders, deliveries, or field conditions on a job you hired us to build.
5. How We Collect Information
We collect information when you:
- fill out the Contact form or a service-request form on Pricing (those forms POST to our form processor, which emails support@santillanus.us);
- email, call, or text us, or send photos of a property;
- schedule or complete a site visit;
- accept a written proposal or sign a contract;
- visit or navigate the Site, including through cookies and similar technologies;
- Accept cookies so an embedded Google Map can load on the Contact page.
6. How We Use Information
We use personal information for legitimate business purposes, including to:
- schedule site visits and walk walls, yards, and lots;
- prepare proposals, take-offs, and written scopes;
- order materials, coordinate labor, and perform masonry, landscape, drainage, and construction work;
- communicate about schedule, weather delays, inspections, and punch lists;
- process deposits, progress payments, and final invoices;
- operate, secure, and improve the Site;
- remember cookie consent and essential Site preferences;
- detect fraud, abuse, or unauthorized activity;
- comply with legal, tax, and recordkeeping duties and protect our rights.
We do not use personal information for purposes that are materially incompatible with those listed above without notice or consent where the law requires it. We do not use your jobsite photos for unrelated advertising without your say-so; see Section 12.
7. Legal Bases for Processing
Where U.S. state privacy laws or other rules apply, we process personal information based on one or more of the following:
- Contract — to prepare a proposal you requested or to perform work under an agreement.
- Consent — when you submit a form, send photos, Accept cookies, or otherwise volunteer information.
- Legitimate interests — to run a construction business, secure the Site, prevent fraud, and follow up on site-visit requests, balanced against your privacy interests.
- Legal obligation — tax, accounting, permit, safety, and law-enforcement requirements.
8. Cookies and Tracking Technologies
Our Site uses cookies and similar technologies for essential function, to remember whether you Accepted or Declined cookies, to remember that the first-visit cover already ran in this tab, and — only after Accept — to load an embedded Google Map on Contact. Typefaces are files we host. We do not load Google Fonts.
We do not currently run a marketing analytics pixel or advertising tracker on this Site. Details, the local-storage key we use, and how to change your choice are in the Cookie Policy.
9. Third-Party Service Providers
We may share information with trusted providers that help us operate, including:
- website hosting and infrastructure;
- email and phone systems;
- the form processor that delivers Contact and Pricing requests to our inbox (currently FormSubmit);
- map providers such as Google Maps, only after you Accept cookies;
- Square, if you pay a deposit or invoice by card through a Square invoice we send;
- your bank, if you pay by check or ACH;
- professional advisors (accountant, attorney, insurer) when reasonably necessary;
- suppliers, fabricators, plant nurseries, haulers, and trade partners named in a proposal or needed to complete the scope.
These parties may access personal information only as needed to do their work. We do not authorize them to use client information for their own unrelated marketing. We do not control cookies Google may set when a map loads; those follow Google's policies. FormSubmit's processing follows FormSubmit's privacy terms. Square's processing follows Square's privacy notice.
10. Payment Processing
This website does not collect card numbers. Contact and Pricing forms POST to FormSubmit, which emails the message to support@santillanus.us. A successful send is not a booking and not a payment.
After a written Proposal we accept payment by check, ACH, or a card invoice processed by Square. Check and ACH are between you and your bank. Card invoices are paid on Square's pages, not on this Site. We do not store a full card number. Amounts we quote are in United States dollars (USD).
Square's handling of card data follows Square's privacy notice. We may keep billing names, amounts, dates, service descriptions, and payment status for accounting, tax, lien, and dispute purposes.
11. How We Share Information
We do not sell personal information. We may disclose information only in these cases:
- to service providers and trades acting on our behalf, as described above;
- to a building department, inspector, utility-locate service (such as 811), HOA, or similar body when the job requires it and you have asked us to perform that work;
- when you direct us to share information (for example, with an architect, engineer, or neighbor);
- in connection with a merger, sale of assets, or corporate reorganization, with appropriate confidentiality;
- to comply with law, legal process, or a government request;
- to protect the rights, property, or safety of SANTILLAN CONSTRUCTION INC, our crew, clients, or others;
- with your consent.
12. Jobsite Photos and Project Records
Construction work produces records: field measurements, photos of substrate and progress, material tickets, and punch-list notes. We keep those as business records for the job, warranty follow-up (if any is in your contract), and disputes.
Unless a written contract says otherwise, we may use non-identifying photos of completed work (a wall, patio, or lot — not a close portrait of you) on the Site or in a proposal to show craft. If you do not want a particular project shown, email support@santillanus.us and we will take reasonable steps to stop new use of those images.
We do not publish a portrait of the company founder on this Site. Do not send photos of children; this Site is not directed to minors.
13. Data Retention
We retain personal information only as long as reasonably needed to:
- finish the job and any punch list;
- answer follow-up questions and warranty issues stated in a contract;
- meet tax, accounting, and legal recordkeeping rules;
- resolve disputes and enforce agreements.
Inquiry emails that never become a job are kept only as long as useful for follow-up and then deleted or archived in the ordinary course. When information is no longer needed, we take reasonable steps to delete, anonymize, or securely dispose of it.
14. Data Security
We use reasonable administrative, technical, and organizational safeguards — including limited internal access on a need-to-know basis and secure hosting for the Site. No method of internet transmission or electronic storage is perfectly secure. We cannot guarantee absolute security.
Jobsite photos on a phone or in email carry ordinary email risk. If a matter is sensitive, say so and we will arrange a more careful channel when practical.
15. Your Privacy Rights
Depending on where you live and applicable law — including the Colorado Privacy Act (CPA) where its thresholds and rights apply — you may have some or all of the following:
- Right to know / access — confirmation of whether we process your personal information and a copy of certain information we hold.
- Right to correction — correction of inaccurate personal information, subject to verification.
- Right to deletion — deletion of personal information we collected from you, subject to legal exceptions (for example, we may retain a contract, invoice, or permit file we are required to keep).
- Right to opt out — opt out of sale, targeted advertising, or certain profiling, where those activities apply. We do not sell personal information or run targeted ads on this Site.
- Right to data portability — a portable copy of certain information where the law requires it.
- Right to non-discrimination — we will not deny service or charge a different price solely because you exercised a privacy right the law gives you.
Rights vary by jurisdiction. We will respond as the law requires and may need to verify your identity first. We are a Colorado construction company; many CPA obligations apply only when a business meets statutory thresholds. We still honor reasonable access, correction, and deletion requests for information we actually hold.
16. How to Submit a Privacy Request
Email support@santillanus.us or call (720) 659-4943. Include enough detail for us to find you (name, email used on the form, property city) and state what you want: access, correction, deletion, or a question about this policy.
We will respond within the time the applicable law requires. If we deny a request, we will say why where we are required to. An authorized agent may submit a request where the law allows, subject to proof of authority.
17. Do Not Sell or Share Personal Information
SANTILLAN CONSTRUCTION INC does not sell personal information. We do not share personal information for cross-context behavioral advertising. If that ever changed, we would update this policy and provide any opt-out the law requires.
18. Children's Privacy
The Site is for adults arranging construction and landscape work. It is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child sent us information, contact us and we will delete it.
19. International Visitors
We operate from the United States. The Site is aimed at Front Range property owners. If you contact us from another country, your information may be processed in the United States, which may have different data-protection rules than your home country.
20. Changes to This Privacy Policy
We may update this policy when our practices, tools, or legal duties change. The new version is posted on this page with a revised "Last Updated" date. Material changes may also be noted on the Site. Continued use of the Site after an update means you accept the revised policy for Site use, except where the law requires a new consent.
A signed construction contract is not rewritten by a website update unless that contract says so.
